GENERAL TERMS AND CONDITIONS OF SALE

1. Acceptance of General Terms and Conditions of Sale and Conclusion of the Contract

1.1 The contract entered into between Four.Ten Industry S.r.l. (hereinafter "Four.Ten") and the Customer (i.e., the natural person making the purchase on the Website, not referring to their commercial, entrepreneurial, or professional activity) shall be deemed concluded with the acceptance, even partial, of the Order by Four.Ten. In the event of non-acceptance of the Order, Four.Ten shall promptly notify the Customer.

1.2 By placing an Order in the various ways provided, using the Order form available on the Website (hereinafter the "Order"), the Customer declares to have read all the information provided during the purchase procedure and fully accepts these general terms and conditions (hereinafter the "Terms").

1.3 These Terms may be printed or saved on a durable medium, in accordance with the provisions of Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

2. Purchase Methods

2.1 The products offered for sale by Four.Ten are exclusively those available on the Four.Ten website at the time the Order is placed, as described in the respective product information sheets.

2.2 It is understood that the images accompanying the product description are for informational purposes only and may not perfectly represent its characteristics, for example, due to differences in color and size caused by the browser or monitor used.

2.3 To place an Order, the Customer must complete the order form in all its parts and submit it after carefully reviewing the Terms and the characteristics of the product(s) they intend to purchase. The Customer may also request an invoice for the purchase, pursuant to Article 22 of Presidential Decree No. 633/1972.

2.4 The correct receipt of the Order is confirmed by Four.Ten via email, sent to the email address provided by the Customer. This confirmation message will summarize the purchase conditions, as required by applicable regulations, and include the data provided in the Order so the Customer can verify and, if necessary, promptly correct any incorrect information.

3. Prices and Payment Methods

3.1 The prices listed on the Website are inclusive of taxes and VAT. Any shipping costs or payment fees will be communicated to the Customer beforehand through the Website or these Terms.

3.2 The following payment methods are available:

  • (i) PayPal
    The Customer may use PayPal according to its specific procedures.

  • (ii) Credit Card
    For purchases made using a credit card, the transaction may occur via PayPal's secure server or another secure server chosen by Four.Ten. Four.Ten will never have access to Customer credit card information.

  • (iii) Cash on Delivery (COD)
    Payment must be made in cash at the time of product delivery. This method involves an additional fee of €5.00. COD is available only for purchases under €999.00.

4. Product Delivery and Related Costs

4.1 Products will be delivered to the address specified by the Customer within 24-48 hours after Order acceptance, at the cost specified on the Website before submission. Four.Ten reserves the right to accept or reject deliveries outside Italy or Europe. Delivery costs and times for international shipments may vary.

4.2 For deliveries to non-EU countries, any import customs duties will be borne by the recipient. The Customer should contact local customs authorities for information on costs and potential import restrictions.

4.3 Delivery times are indicative. Delays or split shipments do not entitle the Customer to refuse delivery or claim compensation.

4.4 Upon delivery, the Customer must verify:

  • The number of packages matches the transport document.
  • The packaging is intact and not damaged or altered.

Any issues must be noted immediately on the delivery document. Claims related to physical integrity, product completeness, or delivery discrepancies must be reported within 7 days of delivery.

5. Right of Withdrawal

5.1 Pursuant to Article 52 of Legislative Decree 206/2005 (as amended by Legislative Decree 21/2014), the Customer may withdraw from the contract without justification or penalties within 14 (fourteen) working days from the product receipt date.

5.2 To exercise this right, the Customer must notify Four.Ten within the specified period at:

5.3 Returned products must be shipped, at the Customer’s expense, within 14 days of withdrawal to:

For EU countries:

For non-EU countries:

The products must be returned intact, unused, complete with all accessories and in their original packaging.

5.4 Four.Ten will refund the full purchase price within 14 days of withdrawal, excluding shipping costs. The refund will be processed using the same payment method used for the original transaction.

5.5 The right of withdrawal is forfeited if:

  • The product or packaging is not intact.
  • Essential product elements or accessories are missing.

6. Warranties

6.1 All products sold by Four.Ten are covered by a 24-month warranty for conformity defects, as per Title III of Legislative Decree 206/2005. The Customer must retain the invoice or payment receipt for warranty purposes.

6.2 The warranty applies only if the product is used correctly and for its intended purpose.

6.3 If repair or replacement is not possible, Four.Ten may refund the amount paid.

6.4 Products returned under warranty must be complete and in original packaging.

8. Privacy

8.1 Personal data collected during the Order process will be processed solely to fulfill the Customer’s requests, in compliance with EU Regulation 2016/679.

9. Applicable Law

9.1 These Terms and the sale contract shall be governed by Italian law. The Court of Rome shall have exclusive jurisdiction over any disputes.
